Parole Violation In Michigan – ChooseGoldman
What is Parole?
Parole is the early release of a prisoner. Not everyone is eligible for this perk. Factors that will play a role in determining whether to grant parole to an inmate are the parolees age, risk to the community, the offense which landed the inmate in prison and the inmates behavior while imprisoned.
Parole Violation Procedure
Parolees are entitled to a hearing on a parole violation as long as the violation is not the result of a conviction for a felony or misdemeanor punishable by any term of imprisonment. Should a hearing become necessary, a parolee is entitled to have a reasonable amount of time to prepare a defense at the hearing. If a parolee claims to be indigent and cannot afford to hire an attorney, whoever is going to conduct the hearing must determine whether that is indeed the case. If it is, an attorney must be appointed.
Parole violation hearings are similar to a trial in the sense that a parolee is entitled to all evidence that will be submitted against him, enter other relevant evidence, has an opportunity to testify on his behalf, and has an opportunity to cross-examine adverse witnesses. If the parole board member or hearings officer determines that a parole violation has occurred by a preponderance of the evidence, a recommendation is made to the parole board. Should the board come to the same conclusion, it can revoke parole and send the offender back to jail/prison or extend the parole period. Of course, should it be found that a parolee has not violated parole, he will be released.
