Some Crimes Cannot be Expunged

There are some crimes that cannot be expunged from ones record, unfortunately. Eligibility Requirements

Only those who have never been convicted of any other criminal offenses may have their record expunged. This is one reason why those who have a single offense on their record may consider getting their record expunged. Should they earn another conviction somewhere down the road, the opportunity to expunge the first offense will be lost. However, there is one exception to this rule, and that is where the prior convictions earned were earned before the offender was 21 years old, and the offenses were no more serious than a misdemeanor or ordinance violation punishable by no more than 90 days in jail or a $1,000 fine or both. Finally, there is a five year waiting period since the time one was convicted or released from imprisonment (whichever occurred later) and the time they may seek an expungement.
