The court will always have the overriding concern about what is in the best interest of the child. For example, the court can determine that in 2020 that is in the best interest of the child to stay with the father. In 2022, the court can say being with the father isn’t in the best interest of the child, so they will modify the custody agreement and switch custody to the mother. If you lose custody, you can always appeal the agreement. You should remember that the appeal court will only look at what the lower court did, and determine whether or not given the facts and circumstances it was the right or wrong thing to do. Appeals may or may not work, but what would typically lead the court to re-evaluate the case would be any change in circumstances. If there is a change in circumstance, you can file a new petition and allege that there has in fact been a change in circumstance.
