However in the scenario where the parents are not married and the father’s name isn’t on the birth certificate, then there is no presumption that he is the father. Therefore if you want to assert your rights as the father and your name is not on the birth certificate, then you will have to file a petition to determine paternity. When that is filed, the court will essentially enter an order requiring DNA testing. The court will determine based on the results whether or not the person filing the case is the father.
