For Michigan residents, benefits received under Michigan’s No-Fault Personal Injury Protection law can cover this potentially expensive financial burden. Fortunately for non-resident bus passengers in Michigan, they are eligible to receive no-fault personal injury benefits as long as one of the two following criteria is met: the non-resident was an occupant of a bus registered in this state, or the non-residents out-of-state insurer has filed a certification of in compliance with section 3163 (MCL 500.3113(c)).

Bus registered in Michigan

So, if you are a non-resident involved in a bus accident in Michigan and the bus has been registered in Michigan, you shall receive the personal protection insurance benefits from the insurer of the motor vehicle (MCL 500.3114(2)). That is, the insurer of the bus is liable for the benefits owed to you under No-Fault PIP. However, the insurer of the bus is only liable for the PIP benefits if you are not entitled to personal protection insurance under any other policy (MCL 500.3114(2)).

Section 3163 Certification

A 3163 certification is required for all auto insurers sanctioned to do business in Michigan. According to this certification, the auto insurer agrees to provide Michigan No-Fault PIP benefits to a non-resident if they are injured in a bus accident in Michigan. However, if the bus is not registered in Michigan and the non-resident files for PIP benefits under section 3163, benefits will be limited to $500,000.
